GOLF SIMULATOR FACILITY USE AGREEMENT, LIABILITY WAIVER AND RELEASE AGREEMENT

Please read this Liability Waiver and Release Agreement (“Agreement”) carefully before participating in any activities at Double Eagle Golf and Cocktail Bar (“Facility”). By signing this Agreement, the undersigned participant (“Participant”) acknowledges and agrees to the following terms:

 

1. ASSUMPTION OF RISK

Participant understands that participation in golf simulator activities, including but not limited to swinging golf clubs, hitting golf balls, use of simulator equipment, food and beverage consumption, and presence in active simulator bays, involves inherent risks that may result in bodily injury, property damage, illness, or death.

Participant voluntarily assumes all risks associated with participation at the Facility, including but not limited to:

  • Being struck by golf clubs or golf balls
  • Slipping, tripping, or falling
  • Equipment malfunction or misuse
  • Injuries caused by other participants or spectators
  • Consumption of alcoholic beverages
  • Negligent acts of other patrons


Participant acknowledges that golf simulator activities require attention and adherence to safety rules at all times.


2. RELEASE OF LIABILITY

In consideration for being permitted to enter and use the Facility, Participant hereby releases, waives, discharges, and covenants not to sue:

  • Greenside Hospitality LLC
  • Double Eagle Golf and Cocktail Bar
  • Its owners, officers, managers, employees, agents, affiliates, contractors, successors, and assigns

from any and all claims, liabilities, demands, damages, costs, expenses, or causes of action arising out of or related to any loss, injury, illness, death, or property damage sustained while at the Facility, whether caused by negligence or otherwise, to the fullest extent permitted by law.

 

3. ALCOHOL CONSUMPTION

Participant acknowledges that alcoholic beverages may be served on the premises. Participant agrees to consume alcohol responsibly and understands that intoxication may increase the risk of injury.

Greenside Hospitality LLC reserves the right to refuse service to any individual who appears intoxicated or poses a safety concern.

Participant assumes full responsibility for any consequences arising from alcohol consumption before, during, or after participation at the Facility.

 

4. RULES AND SAFETY REQUIREMENTS

Participant agrees to:

  • Follow all posted rules and staff instructions
  • Remain aware of surroundings while simulator bays are active
  • Never swing a club while another person is within striking distance
  • Use equipment only as intended
  • Report unsafe conditions or damaged equipment immediately


Greenside Hospitality LLC reserves the right to remove any person acting in an unsafe or disruptive manner without refund.

 

5. MEDICAL FITNESS

Participant certifies that they are physically capable of participating in golf simulator activities and have no medical condition that would make participation unsafe.


Participant authorizes emergency medical treatment if necessary and agrees to be financially responsible for any related medical expenses.


6. PROPERTY DAMAGE

Participant agrees to be financially responsible for any damage caused by intentional misconduct, reckless behavior, or misuse of equipment or facilities.


7. MINORS

Participants under the age of 18. By booking an appointment the Parent or guardian agrees to all terms of this Agreement on behalf of the minor participant and accepts responsibility for the minor’s conduct and safety.

 

8. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Nebraska.

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.


9. ACKNOWLEDGMENT

Participant acknowledges that by booking a reservation:

  • They have carefully read this Agreement
  • They fully understand its contents
  • They understand they are giving up substantial legal rights
  • They agree to this Agreement voluntarily and without inducement
